Dafeamekpor says former Chief Justice Gertrude Torkornoo can contest her dismissal at the Supreme Court

Majority Chief Whip, Rockson-Nelson Dafeamekpor, has said that former Chief Justice Gertrude Araba Esaaba Sackey Torkornoo is not without legal options following her dismissal, stressing that she has the right to challenge the decision at the Supreme Court.

Speaking on Channel One TV’s The Point of View with Selorm Adonoo, the South Dayi MP pointed to constitutional precedent, citing the case of former Electoral Commission chairperson Charlotte Osei.

“When Charlotte Osei was removed under Article 46 procedure, Kweku Baako [renowned journalist] went to the Supreme Court to challenge it. Isn’t it? The Chief Justice can go to the Supreme Court to challenge the findings and recommendations of the committee, which she has the right,” Dafeamekpor explained.

He stressed that the removal process does not necessarily bring finality for the person affected.

“Nobody should think that this is the end. Kweku Baako didn’t find favour with the court. It doesn’t mean that the findings of the committee cannot be challenged in the Supreme Court; it can,” he added.

Justice Torkornoo was removed from office on Monday, September 1, 2025, after President John Dramani Mahama invoked Article 146(9) of the 1992 Constitution. The action followed a petition filed by a citizen, Daniel Ofori, and the recommendation of a committee established under Article 146(6).

Her dismissal, which took immediate effect, has ignited strong debate, with sections of the public, civil society organizations, and political actors warning that the move threatens judicial independence in Ghana.
